These terms cover your use of the Sparkler Room app. They are short, because the service is small and we hold none of your data.
Sparkler Room sends files and messages directly between devices that have paired with each other by scanning a code. Transfers are encrypted end to end. We operate no service that receives or stores what you send, and there is no account.
When two devices cannot reach each other directly, traffic is forwarded through a relay we operate. The relay cannot read it.
Receiving is always free. Anyone can join a room and receive what is sent, whether or not they subscribe.
Do not use Sparkler Room to send material that is unlawful, or that you have no right to send. Because transfers are end-to-end encrypted and never pass through our systems, we cannot see what anyone sends and cannot remove it. What we can do, and will, is respond to reports at support@sparkler.direct and cooperate with authorities where the law requires it.
Within a room, the remedies are yours and take effect immediately: a host can remove any participant and close the room, and anyone can leave.
A host can block saving, block screen capture, and ask to be alerted to screenshots. These are enforced by the app on each device. They are not DRM. Someone running a modified version of the app, or simply photographing their screen with another device, is not prevented by them. We say this inside the app as well, and you should not rely on these controls to protect anything whose disclosure would seriously harm you.
The app is provided as is. Transfers depend on networks we do not control, and we do not guarantee that any particular transfer will succeed, complete, or be fast. We do not guarantee the app will be available without interruption.
To the extent permitted by law, we are not liable for indirect or consequential loss, for lost data, or for anything arising from a transfer that failed, was intercepted after leaving the app, or was retained by someone you sent it to. Because we store nothing, we cannot recover anything for you.
Nothing here limits liability that cannot be limited by law, including your statutory rights as a consumer.
If these terms change, the revised version will be posted here with a new date. Continuing to use the app after that means accepting the change.
